Spousal Sponsorship Outside Document Checklist

Spousal Sponsorship Outside Document Checklist

Outside(Outland) Spousal Sponsorship is a program designed for Canadian citizens and permanent residents to sponsor their spouses who reside outside of Canada. The sponsored spouse remains in their home country while the application is processed.

Residency Requirements Outside(Outland) Spousal Sponsorship :

Canadian Sponsor (Permanent Resident): Must reside in Canada throughout the application process.
Canadian Sponsor (Citizen): May reside abroad during processing, but must demonstrate "an intention to return to Canada and settle in Canada with their foreign spouse once the sponsorship application is approved."

Visiting Canada During Processing of Outside (Outland) Spousal Sponsorship Canada:

Spouses from visa-exempt countries or with valid temporary visas may be able to visit Canada during processing.
However, visitor visa applications for foreign spouses are generally not approved. This is due to the inherent conflict between the temporary nature of a visitor visa and the spouse's intention to permanently reside in Canada. As the excerpt states, "This intention may not be found with a foreign spouse whose intention is to permanently reside with their Canadian spouse in Canada."
Outland Sponsorship allows spouses to remain in their home country while the application is processed.
Residency requirements differ for Canadian sponsors based on their citizenship status.
Visiting Canada during processing is possible, but faces significant challenges due to immigration policy.

The document checklist Outside(Outland) Spousal Sponsorship Canada

  • Document Checklist (First Page): While seemingly redundant, including the checklist itself as the first page of the application package ensures organization and immediate confirmation that all necessary components are present.
  • Application to Sponsor, Sponsorship Agreement and Undertaking (IMM 1344): This form represents the legal commitment between the sponsor (Canadian citizen or permanent resident) and the person being sponsored. Both parties must sign this document.
  • Application Fees Receipt: Proof of payment for all applicable fees, including application fees, biometric fees, and the Right of Permanent Residence fee, is mandatory.
  • Financial Evaluation (IMM 1283): This form is specifically required when the sponsored individual has dependent children who, in turn, have their own dependent children. This assesses the sponsor's financial ability to support the entire family unit.
  • Class of Application: This section requires clear identification of the specific category within the family class program (e.g., spouse, common-law partner, conjugal partner) and whether a work permit is being sought concurrently with the sponsorship.
  • Generic Application Form for Canada (IMM 0008): This standardized form collects essential information about the person being sponsored and any accompanying dependents.
  • Country-Specific Requirements: Any additional documents or forms dictated by the applicant's country of origin must be included here.

Forms for Representation & Information Release

Finally, the checklist includes forms for scenarios involving legal representation or authorized access to personal information:

  • Use of a Representative: This form must be completed if the principal applicant is utilizing the services of an Immigration Consultant or a Lawyer to assist with their application.
  • Authority to Release Personal Information to a Designated Individual (IMM 5475): This form allows the applicant to grant IRCC permission to share their personal information with a specific individual who is not acting as their official representative.
